Business Innovation Stream (subclasses 188A and 888A)

This visa is suitable for small andmedium-sized business owners. After grant temporary visa for 2 years, you canapply for a permanent visa.


Eligibility:

· Under 55 years of age.

· Nominated by a state orterritory government of Austrade on behalf of the Australian government andearn at least 65 points in the point test before apply for the visa.

· You have an overall successfulbusiness career. For 2 out of the 4 fiscal years immediately before you areinvited to apply, you have had an ownership interest in an established businessor businesses that had at least AUD500, 000 turnovers in each of those years.

· At the time of invitation, you,your partner, or you and your partner combined must have total net business andpersonal assets of at least AUD800, 000 that are lawfully acquired andavailable for legal transfer to Australia within two years of the visa beinggranted.

· You need to live in Australiafor at least 1 year (calculated cumulatively) for the duration of the first 2years after the visa is granted. 


Significant Investor Stream(subclasses 188C and 888C)

You, your partner, or you and your partner combined must have net assets of at least AUD5,000,000 that are legally acquired, unencumbered, and available to be used to make the designated investment in Australia for at least four years, then you can apply for apermanent visa. 


Eligibility:

· No upper age limit.

· No business background requirement.

· No related points requirement.

· Live in Australia for at least 40 days per year (calculated cumulatively) for the duration of your temporary visa. 


Business Talent (Permanent) visa (subclass 132)

This program allows you to get permanentvisa in one step and it is more suitable for large and medium-sized businessowners.  You need to invest at least AUD1,500,000to establish a new business or invest designated funding and operate for atleast 2 years.


Eligibility:

· Under 55 years of age.

· You have an overall successfulbusiness career. There is a total annual turnover of at least AUD3,000,000 inone or more of your main businesses in at least 2 of the 4 fiscal yearsimmediately before you are invited to apply

· There are total net assets of at least AUD400,000 as the ownership interest in one or more qualifying businesses and if the qualifying business is a publicly listed company, youshould hold the share of at least 10 % of the total issued capital

· You, your partner, or you andyour partner combined must have total net business and personal assets of at least AUD1,500,000 that are lawfully acquired and available for legal transfer toAustralia within 2 years of the visa being granted.

· IELTS overall test score of atleast 5.0.

· You are nominated by a state orterritory government agency and are invited to apply.

· Although there is no length ofstay requirement, you need to provide evidence of maintaining direct andcontinuous involvement in the day-to-day management of the business. Theimmigration department will supervise you and the operation of your businessfor 2 years.

Temporary Work (Skilled) visa (subclass 457)

This visa is a temporary work visa that isset up by Australian government for Australian companies to introduce all kindsof professionals or skilled workers from overseas. There are more than 400 jobswhich could be applied for this visa including all kinds of managers,professionals and skilled workers.   Thisvisa allows you to work in Australia for up to 4 years. After the employeeswork in Australia for 2 years, they can apply for employer nomination schemevisa.

Australian employers must pay candidatessalary rate which is not less than the minimum annual salary announced by thegovernment. Once the applicant is employed by the employer, he can enjoybenefits such as paid sick leave and four weeks annual leave. In addition, theemployers are obliged to pay superannuation for employee, and candidates enjoyall government mandated benefits such as holidays and payments forovertime.  The spouse of candidate canwork full-time in Australia and his or her children under 18 can receiveprimary and secondary education in public schools for free.


Eligibility:

· You are nominated by anapproved Australian employer.

· You obtain a suitable Skills Assessmentfor that occupation.

· You achieve IELTS test score ofat least 5 in each of the four test components.

· You need to buy healthinsurance.

Employer Nomination Scheme (subclass 186)

It is part of the Permanent EmployerSponsored Visa programme and is usually called Employer Sponsored Migration.Australiangovernment permits enterprises or institutions in Australia recruitprofessionals from overseas and permits applicants employed to work and live inAustralia. Applicants can get permanent visa in one step.

This visa has three streams:

1.The Temporary Residence Transition stream is for subclass 457 visaholders who have worked for two years, while holding a subclass 457 visa, inthe same occupation with their nominating employer, who wants to offer them apermanent position in that occupation.

2.The Direct Entry stream is for people who have never, or onlybriefly, worked in Australia, and have not hold a subclass 457 visa in the pasttwo years.

3.The Agreement stream is for people sponsored by an employer througha negotiated formal labour agreement or a regional migration agreement.


Eligibility:

1.Temporary Residence Transition stream

· You achieve IELTS test score ofat least 5 in each of the four test components

· You hold a subclass 457 visa

2. Direct Entry stream

· You obtain a suitable Skills Assessmentfor that occupation

· You have at least 3 years ofrelevant work experience

· You achieve IELTS test score ofat least 6 in each of the four test components

3.Agreement stream

· You meet the age, skills andEnglish language requirements stated in the agreement.

Regional Sponsored Migration Scheme visa (subclass 187)

It is part of the Australian RegionalSponsored Migration Scheme visa.Subclass 187 visa and subclass 186 visahave thesame three streams (see subclass 186).


Eligibility:

· You are nominated by an approvedAustralian employer for a job in regional Australia.

· You are under 50 years of age.

· You are under TemporaryResidence Transition stream and you do not need to obtain a suitable Skills Assessmentfor that occupation. You achieve IELTS test score of at least 5 in each of thefour test components.

· You are under Direct Entry streamand you obtain a suitable Skills Assessment for that occupation. You achieveIELTS test score of at least 6 in each of the four test components.

· You are under Agreement streamand you must meet the age, skills and English language requirements stated inthe agreement.

Skilled Independent visa (subclass 189)

This visa is for points-tested skilled workerswho are not sponsored by an employer or family member or nominated by a stateor territory government. If the occupation nominated is on the relevant skilledoccupation list, and you earn at least 60 on the points test, you are eligibleto apply for a skilled independent visa.


Eligibility:

· You are invited to apply.

· You are under 50 years of age.

· You are nominated an occupationthat is on the relevant skilled occupation list and obtain a suitable Skills Assessmentfor that occupation.

· You achieve IELTS test score ofat least 6 in each of the four test components.

· You meet certain healthrequirements and character requirements.


Skilled Nominated visa (subclass 190)

This visa suits applicants who have earnedonly 55 on the points test. The applicant can earn 5 points only when theapplicant’s occupation is nominated by an Australian state or territorygovernment agency and the applicant meet other requirements (IELTS, Length ofemployment, Offer or Registration and so on). When the applicant is nominatedby an Australian state or territory government agency, the applicant will beinvited to apply for this visa.


Eligibility:

· You have been invited.

· You are under 50 years of age.

· You are nominated an occupationthat is on the relevant skilled occupation list and obtain a suitable Skills Assessmentfor that occupation.

· You achieve IELTS test score ofat least 6 in each of the four test components.

· You are nominated by anAustralian state or territory government agency.

· You achieve at least 55 on thepoints test. After you are nominated by an Australian state or territorygovernment agency, you achieve 60 points.

Skilled Regional (Provisional) visa (subclass 489)

This visa allows skilled workers to liveand work in specified regional areas in Australia for up to 4 years. You mustlive, study and work in regional and low population-growth metropolitan areafor 2 years after the visa is granted. After you work full-time for 1 yearwithin 3 years after the visa is granted (There is no requirement that the workis related to your occupation) , you can apply for a permanent visa.


Eligibility:

· You have been nominated by anAustralian state or territory or by Austrade on behalf of the Australiangovernment or sponsored by an eligible relative living in a designated area(your occupation is listed in S1). 

Partner visa (subclasses 820 and 801)

This visa suits married applicants or De factoapplicants whose relationship have existed for at least 12 months immediatelybefore application. About 2 years after you lodged your application for thisvisa, you will be assessed for a permanent Partner visa (subclass 801). Beforea permanent partner visa is granted, the temporary visa is valid.


Eligibility:

· You are married to or in a defacto relationship with an:

 -  Australian citizen

 -  Australian permanent resident

 -  Eligible New Zealand citizen.

· You have been in a partnerrelationship with your partner for more than 12 months.

· You must be inside Australiawhen you lodge your application and when the visa is granted.

· If you want to include yourchildren when you are applying, your children should also in Australia.  

Partner (Provisional) visa (subclass 309) and Partner (Migrant) visa (subclass 100)

This visa suits married applicants or Defacto applicants whose relationship have existed for at least 12 monthsimmediately before application. About 2 years after you lodged your applicationfor this visa, you will be assessed for a permanent Partner visa (subclass801). Before a permanent partner visa is granted, the temporary visa is valid.


Eligibility:

· You are married to or in a defacto relationship with an:

-  Australian citizen

-  Australian permanent resident

-  Eligible New Zealand citizen.

You have been in a partner relationship with your partner for more than12 months. 


Prospective Marriage visa (subclass 300)

This visa allows people to come toAustralia to marry their prospective spouse. It is a temporary visa for 9months, and applicant must marry his or her prospective spouse within 9 monthsof being granted the visa. Applicant can apply for a Partner visa after his orher marriage. Once the applicant is granted a Partner visa, he or she canobtain subclass 820 or subclass 309 Visa. After 2 years, the applicant will beassessed for a permanent visa. The applicant will get a permanent visa if theassessment is approved.


Eligibility:

·  You are intended to marry an:

 -  Australian citizen

 -  Australian permanent resident

 -  Eligible New Zealand citizen.

· You must be outside Australiawhen you lodge your application and when the visa is granted.

· You provide proof that you planto marry your prospective spouse within 9 months of being granted the visa.

· You are sponsored by yourprospective spouse in Australia.

· You know your prospectivespouse and have met in person.

· You meet age, health andcharacter requirements.

You cannot be a sponsor if:

· You have previously sponsoredtwo people for migration to Australia and they were granted a Partner orProspective Marriage visa.

· You have sponsored anotherperson for migration to Australia within the past 5 years and they were granteda Partner or Prospective Marriage visa.

· You were sponsored for aPartner or Prospective Spouse visa within the past 5 years.

· You have been granted a Womanat Risk visa (subclass 204) in the last 5 years.

· You have serious criminalrecord regarding children and you are accused.

Contributory Parent (Temporary) visa (subclass 173)

This visa lets parents live in Australia for upto 2 years if they are the parents of an Australian citizen, permanent residentor eligible New Zealand citizen who is settled in Australia. The sponsor shouldhave lived in Australia for at least 2 years before the visa is applied. Thisvisa is temporary and cannot be extended or renewed. The applicant can applyfor subclass 143 visa before temporary visa expires, so that the high visaapplication charges can be paid in 2 instalments.


Eligibility:

· You meet the balance-of-familytest (at least half of your children live permanently in Australia or more of your children live permanently in Australia than in any other country)

· You are prepared to pay muchhigher visa application charges for faster processing.

· You must be outside Australiawhen the visa is granted.

Contributory parent visa (subclass 143)

This visa lets parents live permanently inAustralia if their child is an Australian citizen, permanent resident oreligible New Zealand citizen who is settled in Australia. The sponsor shouldlawfully resident in Australia for at least 2 years. This visa has a shortqueuing time and has a high visa application charge.


Eligibility:

· You have financial ability forcontributory payment.

· You are the holder of a Contributory Parent (Temporary) visa (subclass 173), you can be in or outsideof Australia at the time of lodging your application. You do not need to meetthe balance-of-family test. You need to provide corresponding information onlywhen your family situation changes.

Parent visa (subclass 103) and Aged Parent visa (subclass 804)

This visa lets parents live in Australiapermanently if their child is an Australian citizen, permanent resident oreligible New Zealand citizen who is settled in Australia. The sponsor shouldlawfully resident in Australia for at least two years. There can be longwaiting times of up to 30 years before this visa is approved.


Eligibility:

· At least half of your childrenlive permanently in Australia or more of your children live permanently inAustralia than in any other country.You meet the balance-of-family test.

· You have financial support for 2years.

· You meet health and characterrequirements.

· No criminal record. 

Child visa (subclass 101) and Child visa (subclass 802)

This visa is for a child who is outside Australiato come to Australia to live with their parents. The child is applying outsideAustralia and sponsored by an eligible parent.


Eligibility:

The child must be:

· The biological child or adoptedchild of the sponsoring parent.

· A full-time student between 18and 25 years of age, single and sponsored by their parent or their parent'spartner.

The sponsor must be:

· A step-parent who is no longerthe partner of the child's parent but has a legal responsibility to care forthe child and the child is younger than 18 years of age.

· An adoptive parent who adoptedthe child before you became an Australian citizen, the holder of an Australianpermanent resident visa, or eligible New Zealand citizen. When the child isadopted, he or she must be younger than 18 years of age and single. Before thevisa is applied, adoptive parents must be the sponsors of the adoptive child.
